Terms of service.

The rules of the road. Short, plain, fair.

These Terms of Service ("Terms") govern your use of arc-relay ("the Service"), operated at arc-relay.com by Hoopes Group LLC ("we", "us", "our"), a limited liability company organized in [STATE_OF_FORMATION], with a registered address at [POSTAL_ADDRESS]. Add-ons and overages

Add-ons are billed on the same monthly cycle as your subscription. You may remove an add-on at any time, effective at the end of the current billing period.

EU/UK/Swiss consumer right of withdrawal

If you are a consumer resident in the European Union, the United Kingdom, or Switzerland, you have a 14-day right of withdrawal from the date your paid subscription begins. You may cancel within 14 days for a full refund by emailing [email protected] from the email address on your account. Once you actively use the Service to relay mail or generate AI replies, you are deemed to have requested immediate performance and your right of withdrawal lapses to the extent the Service has already been performed.

Plan limits

Each plan has defined limits on domains, monthly forwards, aliases per domain, API requests, and feature access. Exceeding forwarding or API limits will result in temporary rejection until the next billing cycle or a plan upgrade. We will not silently drop or delete email — senders receive a temporary rejection (451) so their mail server retries.

The Email Health Score API and related tools (DMARC checker, SPF validator, header analyzer) are publicly available without an account. Use of these public endpoints is subject to rate limiting. Automated bulk querying without an API key may result in temporary IP-level blocking.

The arc-relay name, logo, and website content are our property. You retain full ownership of your email content and domain configurations. We claim no rights over email that passes through the relay.

14. Data Processing Agreement (B2B)

If you use arc-relay to process personal data on behalf of your own customers, employees, or end users (for example, an organization forwarding employee mail), you act as the data controller and arc-relay acts as your data processor under GDPR Art. 28 and the UK GDPR.

Our standard Data Processing Agreement (DPA), which incorporates the EU Standard Contractual Clauses for international transfers and the UK Addendum, is incorporated into these Terms by reference. A signed counterpart is available on request from [email protected]. The current list of sub-processors is published in our Privacy Policy, Section 6.

15. Indemnification

You agree to indemnify and hold arc-relay harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Governing law

These Terms are governed by the laws of the State of Washington, United States. Any disputes will be resolved in the courts of Clark County, Washington. Nothing in this section deprives consumers in the European Union, the United Kingdom, or Switzerland of mandatory consumer-protection rights they enjoy under the law of their country of habitual residence; such consumers may also bring proceedings before the courts of their country of residence.

17. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page, and for substantive changes affecting your rights or obligations, by email to the address on your account at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.
